Terms Of Service
By signing up and actively using the WhistleStop-Cafe program you agree to all terms and conditions set forth in this agreement. WhistleStop-Cafe may, at any time, choose to edit, add and/or delete portions of this agreement and impose changes without prior notification of its members. Members will be informed of any and all changes to this policy via an email to their primary contact email address provided upon signing up with WhistleStop-Cafe. If any modification is unacceptable to you, your only recourse is to terminate this agreement. Your continued participation in the WhistleStop-Cafe program following our posting of a change in policy notice or new agreement on our site will constitute binding acceptance to the change.
You must be 13 years of age or older to participate in this program. Our program is open to International members and is void where prohibited by local governing laws. You MUST be able to read and understand English to maintain an account at WhistleStop-Cafe. You must click a link at least once every 15 days. Inactive accounts are deleted regularly. You must CLICK A PAID LINK, email or ptc, just logging into your account does not remove you from the inactive report. The inactive report is used to delete inactive members.
Once an account is deleted for any reason, inactivity, cheating, violating TOS, there is no way to get it back. Once an account is deleted all your info is gone
You agree to and must use your own name and email address in the sign-up process and may not assume a false identity. You may not sign-up multiple times with different email addresses. Your computer must not be shared with another individual that has an existing WhistleStop-Cafe account. You must have your OWN payment processor ID - sharing a payment processor account with another member will be considered a duplicate account and both will be removed. If your IP address and your country does not match, your account will be terminated and all unpaid earnings will be forfeited. If you have false or missing information your account will be deleted.
Should any instances of fraud, system abuse, or any type of activity deemed to be inappropriate or illegal by WhistleStop-Cafe be detected here or at another site/program it may result in member termination and possible legal action.
You must maintain your email account that you used when signing up WhistleStop-Cafe. You must maintain your e-mail account that you used when signing up with WhistleStop-Cafe. You agree to receive e-mail advertising from WhistleStop-Cafe.
In the event your e-mail account on file becomes bouncing our messages 5
times, closed or blocked to messages from WhistleStop-Cafe, your account will be terminated. This especially applies to e-mail accounts returned for being Full. Any member sending us gibberish will result in automatic termination of account and Forfeiture of All earnings to date of termination. Auto-responses will also be deleted immediately. Members have the option of
receiving paid emails sent to their address on file, to the site inbox only where you can read from members area or both. The mails you
receive at your address on file and those in the site inbox will be same.
If you are going on vacation, login to your user info page in the members area and set your account to vacation status by checking the vacation box and then clicking the save changes button near bottom of page. When you return from vacation you must login, uncheck the vacation box, and then click save changes button to start
receiving paid mails again. You do not receive credit from referrals while set in vacation mode.
Vacation mode is limited to 60 days unless special written request has been made and approved by webmaster, this will only be granted in extreme circumstances. It is members sole responsibility to set themselves to vacation setting. DO NOT email webmaster requesting them to hold your mails till such date as you return.
All correspondence sent to admin or support should have your username listed. All accounts are maintained by your chosen username.
If you cannot remember your password, click on the forgot password link, enter your email address and the system will email it to you
IF YOU ARE NOT FROM ONE OF THE FOLLOWING COUNTRIES AND FOUND TO BE CLICKING SEARCH LINKS, YOU WILL HAVE YOUR ACCOUNT DELETED IMMEDIATELY AND WITHOUT QUESTION: Australia, Austria, Belgium, Canada, Denmark, Finland, France, Germany, Greece, Iceland, Italy, Netherlands, New Zealand, Norway, Portugal, Spain, Sweden, Switzerland, United Kingdom and United States.
Anyone from the search restricted country that is found to have clicked on Search Links will forfeit their
accounts and all earnings WITHOUT WARNING!
Keywords / Interests :
We have several "bad/cheat" keywords/interests, this assists us in finding the members that can not understand English. If your account is found to have ANY of these keywords selected your account will be deleted and all earnings forfeited.
Cheat Links / English Tests:
As a member of WhistleStop-Cafe you agree to receive occasional Reading Test / English test / cheat links. While we do not enjoy sending them, they are a necessary evil. Members who fail the English/Reading tests and/or click cheat links will have their accounts deleted and forfeit all earnings accumulated in their account. We have a 1 strike policy at WhistleStop-Cafe, there are no second chances. ( All cheat links/English tests/Reading tests will be sent SOLO with no other advertisements )
Relationship of the Parties:
You and WhistleStop-Cafe are independent contractors, and nothing in this Agreement creates any partnership, joint venture, agency, franchise, sales representative or employment relationship between you and Whistlestop-Cafe. You understand that you do not have authority to make or accept any offers or make any representations on behalf of WhistleStop-Cafe. You may not make any statement, whether on your site or otherwise, that would contradict anything in this section. You are solely responsible for the reporting and payment of any taxes for money earned while using the program.
Limitation of Liability:
WhistleStop-Cafe will not be liable for lost profits, lost business opportunities, or any other indirect, special, punitive, incidental or consequential damages arising out of or related to this Agreement or WhistleStop-Cafe program, even if WhistleStop-Cafe has been advised of the possibility of such damages. Furthermore, WhistleStop-Cafe aggregate liability arising under this Agreement will not exceed the amount of the total fees paid or payable to you under this Agreement. The provisions of this Section survive termination or expiration of the Agreement.
Payments:
Members may earn by receiving paid-emails and visiting the advertiser websites after they have entered their member ID in the area on the website provided by WhistleStop-Cafe. Members may earn by referring new members to the WhistleStop-Cafe program. Members will earn referrals earnings. Members will be paid via E-gold (10% fee). WhistleStop-Cafe will pay members when their balance reaches $1.00 and they request payment. Payments will be made within 30 days or a reasonable time after. Payments are based on avaliability of funds for that payment processor. Members from CHINA, INDIA, VIETNAM, IRAN, IRAQ can redeem for ads only!
Spam:
You may not promote your referral links through unsolicited emailing (i.e. SPAMMING), newsgroup postings, or any other method of mass communication. Failure to comply will result in immediate termination of your membership with Whistlestop-Cafe and may result in legal prosecution. WhistleStop-Cafe strictly enforces anti-Spamming laws. Spamming is a federal crime. Any member caught Spamming will not only have their account terminated immediately and lose any past, present and future earnings, but shall also be held liable for Spamming as we shall cooperate with any authorities and investigations that may arise from the Spamming incident. WhistleStop-Cafe may charge up to $5 per spam email sent. Multiple sign-ups shall be grounds for immediate termination of all involved accounts. Signing up multiple times from the same computer also constitutes fraud. WhistleStop-Cafe will file charges for recovery of any earnings received from multiple sign-ups.
